This Privacy Policy explains how Tipsy Music Oy (“Tipsy Music”, “we”, “us”, or “our”) collects, uses, shares, and otherwise processes personal data when you use the Tipsy Music service, including our website, web application, mobile applications, and related services (together, the “Service”).

This Privacy Policy applies to different types of users of the Service, including audience members, artists/performers, and website or app visitors.

2. Who This Policy Applies To

This Privacy Policy applies to personal data processed in connection with:

  • users who browse or use the Service;
  • audience members who join events, submit requests, or send tips;
  • artists/performers who create profiles, create or manage events, receive requests, and use payout-related features; and

persons who contact us for support or other communications.

3. Personal Data We Collect

The personal data we collect depends on how you use the Service.

A. Account and profile information

If you create an account or sign in to the Service, we may process data such as:

  • email address;
  • authentication-related information;
  • username, display name, profile information, or other account details you choose to provide; and

account preferences and settings.

B. Audience interaction and event-related information

If you use the Service as an audience member, we may process data such as:

  • event participation information;
  • song requests and related interaction data;
  • tip-related activity;
  • support requests or communications; and

technical and usage data related to your use of the Service.

Some audience features may be available without creating an account. Even where no account is created, we may still process technical, device, usage, and payment-related data as described in this Privacy Policy.

C. Artist / performer data

If you use the Service as an artist or performer, we may process data such as:

  • artist profile information;
  • event creation and management information, including event location, venue information where available, event date, and event time;
  • song catalog and related content;
  • request-related interaction data;
  • event and performance history, including songs played during Events;
  • request, ranking, and event interaction history related to Artist Events;
  • payout-related information;
  • tip, fee, earnings, and transaction information;
  • onboarding, verification, and compliance-related information; and

communications with us relating to account status, support, restrictions, disputes, or compliance.

D. Payment, payout, and transaction information

Payments and payouts are processed by third-party payment providers such as Stripe. Depending on your role and how you use the Service, personal data processed in connection with payments or payouts may include:

  • payment status;
  • transaction amount;
  • timestamps;
  • payment or payout identifiers;
  • account status information;
  • limited billing or payment-related information;
  • payout-related information;
  • fee-related information; and

fraud-prevention, dispute, refund, reversal, or chargeback-related information.

Tipsy Music does not store full payment card details.

E. Verification, compliance, tax, and eligibility information

Where relevant to the operation of the Service, payout functionality, legal compliance, or platform safety, we may process data such as:

  • legal name and contact details;
  • country of residence or tax residence;
  • date of birth or age/eligibility confirmations, where needed to enforce Service eligibility rules;
  • business status information, where applicable;
  • taxpayer identification number, VAT number, or similar information where applicable;
  • payment or payout account information where relevant;
  • information relating to legal, tax, accounting, fraud-prevention, or compliance obligations; and

records relating to account restrictions, reviews, or compliance actions.

F. Automatically collected technical and usage information

When you use the Service, we may automatically collect technical and usage data such as:

  • IP address;
  • device type;
  • browser type;
  • operating system;
  • app and device identifiers;
  • language and time zone;
  • pages, screens, or features viewed;
  • referral information;
  • approximate timestamps and activity logs; and

analytics or performance data relating to use of the Service.

G. Support and communications data

If you contact us, we may process:

  • your name and contact details;
  • the content of your message;
  • attachments or screenshots you send us; and

records of support handling and related follow-up.

4. Sources of Personal Data

We may collect personal data:

  • directly from you when you create an account, use the Service, create or manage Events, send a request, send a tip, apply for payouts, contact support, or otherwise interact with us;
  • from payment and payout providers such as Stripe in connection with onboarding, payment processing, payout operations, verification, account status, disputes, refunds, reversals, or compliance;
  • from analytics, authentication, hosting, and infrastructure providers used to operate the Service; and

from your device or browser automatically when you access or use the Service.

5. How We Use Personal Data and Our Legal Bases

We process personal data only where we have a valid legal basis under applicable data protection law.

A. To provide the Service and manage accounts

Legal basis: performance of a contract

We use personal data to:

  • create and manage user accounts;
  • provide login and authentication functionality;
  • operate artist and audience features;
  • enable event participation, requests, interactions, and Artist Event management;
  • display event history, request history, ranking-related features, and played-song information where relevant to the Service;
  • provide customer support; and

communicate with users about their accounts or use of the Service.

B. To process payments, payouts, and related operations

Legal basis: performance of a contract

We use personal data to:

  • enable tipping and related payment flows;
  • support payout functionality for artists;
  • manage payment-related records;
  • handle refunds, reversals, disputes, or payment issues; and

communicate about payment or payout status.

C. To maintain safety, prevent fraud, and protect the Service

Legal basis: legitimate interests

We use personal data to:

  • monitor misuse, fraud, abuse, or suspicious activity;
  • protect the security and integrity of the Service;
  • investigate manipulation, chargeback abuse, fake accounts, or other harmful behavior;
  • enforce our Terms of Service; and

protect Tipsy Music, users, payment providers, and third parties from legal, regulatory, or security risks.

Our legitimate interests include operating a secure and trustworthy platform, preventing fraud and abuse, and protecting our business and users.

D. To comply with legal, tax, accounting, and regulatory obligations

Legal basis: compliance with legal obligations

We use personal data to:

  • comply with accounting, bookkeeping, tax, reporting, and regulatory obligations;
  • comply with payment, verification, anti-fraud, and compliance requirements;

We may process age or eligibility-related information to:

  • apply our 18+ eligibility rule;
  • restrict access to users who do not meet eligibility requirements; and

protect the Service and users from misuse or legal risk.

6. When Providing Data Is Necessary

Some personal data is required in order to provide the Service or specific features of it.

If you do not provide data required for account creation, payment processing, payout functionality, verification, legal compliance, or support handling, we may be unable to create or maintain your account, provide certain features, process payments or payouts, or respond fully to your request.

7. Sharing of Personal Data

We may share personal data with trusted recipients where necessary to operate the Service or comply with legal obligations, including:

  • payment and payout providers, such as Stripe;
  • authentication, hosting, database, and infrastructure providers, such as Google Firebase and related Google Cloud services;
  • analytics providers, such as Google Analytics or similar services;
  • professional advisers, such as accountants, auditors, lawyers, and other advisers where reasonably necessary;
  • competent public authorities, courts, regulators, tax authorities, law enforcement, or other authorities where required by law or valid legal process; and

other service providers that help us operate, secure, support, or improve the Service.

We do not sell personal data.

8. International Data Transfers

Some service providers we use may process personal data outside the European Economic Area.

Where required, such transfers are protected by appropriate safeguards under applicable data protection law, such as standard contractual clauses approved by the European Commission or other lawful transfer mechanisms.

9. Data Retention

We retain personal data only for as long as necessary for the purposes described in this Privacy Policy and as required by applicable law.

In general:

  • account and profile data are retained for as long as the account remains active and for a reasonable period thereafter where needed for support, dispute handling, security, or legal compliance;
  • event, performance, request, ranking, and played-song history may be retained for as long as needed to provide Service features, support users, investigate issues, maintain records, or comply with legal obligations;
  • payment, payout, transaction, accounting, tax, and reporting-related records may be retained for the period required by applicable accounting, tax, reporting, and regulatory obligations;
  • verification, compliance, dispute, refund, reversal, and restriction records may be retained for as long as needed to satisfy legal, fraud-prevention, payment-provider, audit, or enforcement requirements;
  • support communications may be retained for as long as reasonably necessary to manage support, disputes, or follow-up;

analytics and technical logs are retained according to our operational needs, provider settings, and applicable law.

When personal data is no longer needed, we will delete it or anonymize it where appropriate.

10. Age and Eligibility

The Service is intended only for users who are at least 18 years old.

We do not knowingly offer the Service to persons under 18. If we reasonably believe that a user is under 18 or has provided inaccurate age or eligibility information, we may restrict, suspend, or terminate access to the Service and take related account action where appropriate.

We do not claim to perform comprehensive active age verification for all users. However, we may process age or eligibility-related information where reasonably necessary to apply our Service rules or protect the Service.

14. Account Deletion

If account deletion functionality is available in the Service, you may use that functionality to request deletion of your account.

You may also contact us at support@tipsymusic.app regarding account deletion or related requests.

Please note that deleting an account does not always require immediate deletion of all related personal data where retention is necessary for legal, accounting, security, fraud-prevention, dispute-handling, reporting, or similar legitimate purposes.

15. Changes to This Privacy Policy

We may update this Privacy Policy from time to time.

The latest version will be made available through the Service or on our website and will indicate the date of the latest update. If changes are material, we may provide additional notice where appropriate.
